Abstract:随着市场经济的不断发展和企业间竞争的加剧,市场经营者为了争夺市场而出现的商标权与商号权的冲突愈发明显.本文阐述了二者权利冲突的表现形式,分析问题产生的原因,指出现有立法规定的不足.提出为了完善商标、商号立法及相互间的协调,应当结合我国的现实情况和当前法律背景,建立解决商标权和商号权冲突的有效对策.
