Abstract:比例原则作为行政法领域的一项原则,目的是为了防止公权力对私权利的过度干预.随着比例原则适用范围的演变,该项原则在逐渐向私法领域渗透.知识产权作为私法的一个分支,当然可以引用比例原则.文章首先介绍了比例原则的来源与发展历史,并对其适用在知识产权领域的可行性和必要性进行分析;其次阐述比例原则在知识产权领域的具体运用,并指出其中存在的问题;最后针对上述问题的解决措施进行有针对性探讨,以期对具体立法能有一些借鉴意义.
