网页快照著作权侵权问题研究

Abstract:本文从分析搜索引擎服务商在未经网页著作权人的许可利用网页快照,对网页进行复制、存储、允许网络用户对该复制的快照进行访问的相关行为的定性入手,考察其行为是否构成网页著作权侵权,传统的著作权抗辩事由是否可以继续运用,以及提出网页快照是否侵权不应一概而论,而应借鉴灵活开放的“合理使用”标准确立其存在的合法性的观点.
