Abstract: There are many fundamental issues about the 'basic patent' that need academia to answer. Therefore we take advantage of several classic cases to conclude and answer some questions like 'what', 'where they came from', 'where to go' and so on. It is consider that basic patent is derived from basic research, and produced from the patented form of the basic invention which is the results of technical science research. In view of the abun-dant policy implications the basic patent contained, the policy design facing to basic patent fostering is concluded in order to enhance our capabilities of independent innovation with the cooperation of various resource factors.
